Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BatchMakes website and application (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The service

BatchMakes provides production and operations software for small-batch makers, including recipes, batches, inventory, sales, costing and related tools. We may add, change or remove features over time to improve the Service.

Accounts

You are responsible for the accuracy of your account details and for keeping your password confidential. You are responsible for activity that happens under your account. Notify us promptly of any unauthorized use.

Acceptable use

You agree not to:

• use the Service unlawfully or to infringe others’ rights;
• attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
• upload malicious code or misuse another user’s data.

Your data and content

You retain ownership of the business data and content you enter. You grant us the limited rights needed to host, process and display that content solely to operate and support the Service. How we handle personal data is described in our Privacy Policy.

Plans and billing

The Service is offered in tiers: a free plan you can use for as long as you like, and a paid Business plan. Where paid subscriptions apply, pricing, billing cycle and any taxes will be shown before you are charged, and you may cancel in accordance with the plan terms. Fees are non-refundable except where required by law.

Availability and changes

We work to keep the Service available and reliable, but it is provided on an “as available” basis and may experience downtime, maintenance or changes. We may modify or discontinue features with reasonable notice where practical.

No professional advice

The Service helps you organize your operations and finances, but it is a management aid, not professional advice. Figures such as costs, margins, duty and profit are estimates to support your own decisions and are not financial, legal, tax or accounting advice. You are responsible for your own compliance, filings and business decisions.

Limitation of liability

To the maximum extent permitted by law, BatchMakes is not liable for indirect, incidental or consequential damages, or for lost profits or data, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. On termination, your right to use the Service ends; provisions that by their nature should survive will continue to apply.

Governing law

These Terms are governed by the laws of Bulgaria and the European Union, without regard to conflict-of-law rules. Courts located in Bulgaria will have jurisdiction, subject to any mandatory consumer protections that apply where you live.

Changes to these terms

We may update these Terms from time to time. The updated version will be posted here with a new “last updated” date; continued use of the Service after changes take effect means you accept the revised Terms.
